Helping you to understand the law: Workers’ Compensation

Many people suffer accidents at work due to many different causes. Workers’ compensation laws provide money and medical benefits to an employee who has an injury as a result of an accident or occupational disease on the job. These laws help protect workers and their families against any of the hardships that arise because of injury or death at the work place. An injured worker often makes the mistake of focusing on the immediate issues of medical bills or a lost paycheck, and fails to consider the long-term implications of his or her injury. Yet many work-related injuries can have serious long term effects on personal health or income earning ability.

Under the Illinois Workers’ Compensation Act, employers are required to obtain workers’ compensation insurance, post a notice in each workplace that lists the insurance carrier and explains workers’ rights, keep records of work- related injuries and report those accidents involving more than three lost workdays. Additionally, an employer is prohibited from discharging an employee for exercising his or her rights under the law. Also, employers may not charge the employee in any way for workers’ compensation insurance premiums or benefits that the employer is required to pay.

Bio: Herb Franks, Senior Partner

Herb excels in personal injury and worker’s compensation cases and has served as Chairman of the Illinois State Bar Association’s Worker’s Compensation Council. He is widely recognized for his strong courtroom abilities and is a respected litigator.

Herb was one of the first McHenry County lawyers to get a million dollar jury verdict for injury. Herb has been an officer of the Illinois Trial Lawyers Association, served as Special Assistant General of Illinois and recently completed his term as President of the Illinois State Bar Association.
